The High Court has orderd NASA leaders led by Raila Odinga
to file their responses within 48 hours in a case where a Jubilee MP has sought
to compel the Opposition leader to participate in the repeat presidential
election.
The orders were made on Monday after the Judge learnt that
the NASA team was yet to respond to the suit filed by Pokot South MP David
Pkosing.
The Jubilee MP had named Mr Odinga, Kalonzo Musyoka, Musalia
Mudavadi and Moses Wetang'ula as respondents in the case.
In his submissions to the court, Pkosing claims that the
NASA principals have hatched a campaign to throw Kenya into a constitutional
crisis.
“The said campaign has also sought to secure various legal,
administrative and operational reforms before the fresh presidential elections
ordered by the Supreme Court is held. The said fresh presidential elections
must be held by 31st October, 2017,” the Jubilee MP stated in court papers.
The MP has sought orders to issue a declaration that failure to participate in the repeat election would be an act of treason and contempt of court.
Odinga’s team has consistently declared that there would be
no election on the October 26 date that was set by the IEBC, unless their
demands are fully met.
