NASA leader Raila Odinga’s home County of Siaya becomes the
first to pass the Coalition’s proposed People’s Assembly bill.
Siaya county assembly this afternoon (Wednesday 8th) passed
the Bill that waits being signed into law by Governor Cornel Rasanga.
The MCAs claimed that the presidential elections held on 8th
August and 26th October 2017 were each null and void.
The County legislators claimed that considering the low
turnout in the presidential elections held on the latter date, President Uhuru
Kenyatta did not have a constitutional authority or legitimacy to govern.
Speaking during the debate on the motion tabled by Central
Sakwa MCA Johannes Andiego (Chief whip), the Speaker George Okode said that the
house had resolved to form a people’s assembly to discuss and determine the
affairs of the country and at the same time recommend a pathway towards
objectives and freedoms provided in the constitution.
“The house and its membership will participate in the
proceedings of the people’s assembly and will constitute a special college for
the appointments or election of members, delegations and observers to the
people,” said the speaker while addressing the house.
The Speaker further argued that the house had also resolved
that a true independent electoral and boundaries commission(IEBC) be
established with the view of holding a fresh presidential election on or
before 9th February 2018.
“The action and performance of constitutional commissions
including IEBC, the National police service, National Intelligence Service, the
public service commission and Ethics and Anti-corruption commission must be
reviewed with the purpose of ensuring that the said commissions are independent
to enable them protect the sovereignty of the people and to promote
constitutionalism,” he added.
MCA Andiego led his counterparts in claiming that the
exercise of the executive authority by the President has in the past few years
reintroduced the trappings of imperial presidency and despotic tendencies in
the conduct of public affairs.
“We know the parliament has been legislating
unconstitutionally, illegally, devoid of democratically and proposing draconian
laws that contravene the Bill of rights and principles for electoral system,”
noted Andiego.
His counterpart Usonga ward MCA, Sylvester Madialo who
seconded the motion argued that God was the only supreme and Superior Being
stating that a government is only Democratic if majority have their way and
minority have their say.
“The assembly shall be judged by resolutions in which we
stand up to defend the constitution and the people. We will demonstrate
peacefully to protect our Democratic space and join our Commander, National
Super Alliance principal Raila Odinga to resist the oppressors,” claimed
Madialo.
South East Alego MCA Joseph Mboha said that they will not
recognize the 26th October elections and Mr Kenyatta as the president
while his colleague MCA Mboha said that they will join their NASA principals in
resisting to fight for a better Kenya.
“We are guided by the constitution and the Supreme court
verdict directing us to go for fresh presidential election and not the kind of
sham poll witnessed. We must send a message that nobody is so small and can be
ignored in this country, that there is any community that should be forgotten.
We must tell them that this country is either one or none,” added Mboha.
