Chief Justice David Maraga has now identified the mistake
that the Independent Electoral and Boundaries
Commission (IEBC) made that led to the nullification of President
Uhuru Kenyatta's win.
While reading the full judgment on
Wednesday, Maraga castigated the electoral body for defying court's
orders to open the IEBC servers.
This meant that failure of IEBC to open the servers
could have helped debunk NASA's claims that the system was hacked.
The Opposition, led by Raila Odinga had alleged that the
IEBC system was hacked by people who used the late
Chris Msando’s logins to manipulate the numbers in favor of Kenyatta.
According to the supreme court, it held that IEBC chairman
Wafula Chebukati was responsible for failure to explain why poll results
were not transmitted in the prescribed manner.
“Nasa proved that the IEBC declared the presidential winner
before receiving all 40,883 Forms 34A,” Part of the judgement read.
Maraga added," There was no reasonable explanation
why some forms had security features while others missed."
