Mutahi Ngunyi Reveals Raila's Next Move After Pulling Out Of Repeat Election

Controversial political analyst Mutahi Ngunyi has now claimed that NASA leader Raila Odinga is waiting for the 60 days, provided in the constitution to end on October 31st before he moves to the supreme court again.

According to Ngunyi, Odinga will now argue that President Uhuru Kenyatta's term in office has expired and push for a caretaker Government to be installed.

"1st NOVEMBER, NASA goes to MARAGA arguing Uhuru's mandate expired on Oct 31st.Caretaker President is installed by MARAGA. And Coup continues," Ngunyi wrote.
He also noted that Jubilee did not see the bigger picture after CJ David Maraga nullified Kenyatta's win and warned them not to celebrate.

"Jubilee DID NOT see the MARAGA Scheme. They SHOULD not CELEBRATE before they UNDERSTAND the Raila WITHDRAWAL Scheme. It is UGLY!," Ngunyi stated.

Hours after the former Prime Minister withdrew from the race, Kenyatta and his deputy William Ruto demanded that IEBC chairman Wafula Chebukati declare him the winner.

However, this might be a difficult option if the 2013 supreme court ruling is anything to go buy.
According to the ruling, if one of the candidate withdraws in a repeat poll, the planned election is declared null and void, with a fresh nomination ensuing.

"[290] Suppose, however, that the candidates, or a candidate who took part in the original election, dies or abandons the electoral quest before the scheduled date: then the provisions of Article 138(1) (b) would become applicable, with fresh nominations ensuing," the law states.

Another possibility is that IEBC could decide to declare Kenyatta the winner, but NASA would still have the option of challenging the decision in court.
