JSC filed an application before High Court Judge Chacha Mwita seeking to have Justice Ndung'u defend herself in person after she filed an affidavit against a petition filed by Lawyer Apollo Mboya against her.
The Commission further asked to cross-examine the Lady Justice over the minutes of a meeting held by Supreme Court judges on October 6.
Last month, Mboya filed a petition accusing Ms Ndung'u and Judge Jackton Boma Ojwang of going on strike thus crippling the courts operations for close to two weeks.
Mboya wanted JSC directed to investigate Justice Ndung'u for participating in the illegal strike.
The Lawyer also sought an order directing JSC to recommend the formation of a tribunal to probe Ms Ndungu's conduct.
Justice Ndung'u, however, filed an affidavit challenging JSC's decision to castigate her, arguing that she was not accorded a fair hearing
The Judge wanted the High Court to determine the parameters through which the JSC could operate to avoid any potential abuse of the Commission's powers.
Judge Mwita is set to give further directions on the matter on October 9.
