The High court has said that all the presidential candidates
who were presidential in the August 8 polls should be in the ballot paper in the
October 26 fresh presidential elections. The court said that it would
discriminatory to not allow Ekuru Aukot to be on the ballot as it would be a
violation of his human right to political participation.
The High court has defined the word ‘fresh’ Under article
140(3) should not be embossed with article 138(5) as they serve different
situations and on a similar scenario.

and nullified the August polls meant that the elections were void and that it
was the right of all presidential candidates to appear on the ballot.
