Embakasi East MP Babu Owino has moved to the Court of Appeal to challenge a High Court decision that nullified his election as MP.
In his suit at the appellate court, Owino stated that he was dissatisfied by Justice Joseph Sergon's ruling as delivered on March 2nd.
Justice Sergon ruled that Owino's election as Embakasi East MP was marred by election irregularities and that it did not meet the threshold of a free and fair election.
The judge noted that the current MP had coerced and intimidated IEBC officials into releasing the results before due process was followed.
The results of the August 8 election had been challenged by Francis Mureithi of the Jubilee Party.
Owino, who is a vocal member of the NASA coalition, stated that the ruling was politically motivated and aimed at punishing him over his stance in the Opposition coalition.
