Interior Cabinet Secretary Fred Matiang'i, Inspector-General of Police Joseph Boinnet and Immigration Director Gordon Kihalangwa have on Thursday been ordered to pay a fine of Sh200,000 that willbe deducted from their next salaries
Delivering the ruling at Milimani Law Courts, Judge George Odunga wondered why the government officials had failed to show up in court or get in touch with their lawyers, describing it as a 'display of arrogance'.
"The respondents are in charge of security systems in the country, if they have no knowledge of the events that have been widely covered by the media then they do not deserve to hold such office," Odunga stated.
He further noted that they had acted in contravention of the oath they took, and noted that they had disregarded Article 74 of the Constitution which addresses the conduct of public officers.
Odunga also stated that the trio had no regard for the law and asserted that orders for their arrest would be difficult to execute as their juniors would be the ones tasked with the job.
The trio did not show up in court even after their lawyers were given an hour to find them before the sentencing.
As the sentencing hearing initially kicked off in the morning, government lawyers argued that the orders had been issued late on Wednesday and it had been difficult to get in touch with the officials over the matter.
Odunga had on Wednesday found the three in contempt of court, convicted them and ordered that they appear before the court for sentencing on Thursday.
This was after they failed to comply with court orders to release self-styled National Resistance Movement (NRM) General Miguna Miguna who was being held by police officers at the Jomo Kenyatta International Airport (JKIA).
Miguna was deported for the second time in 2 months on Thursday night when he was put on a Dubai-bound flight.
The lawyer maintained that he was drugged by state agents before being bundled on the plane.
Officials had on Tuesday night tried to force Miguna on a Dubai-bound plane, but the move failed after Miguna protested to the Captain.
He is currently in Dubai where he was taken to a hospital to reveive medical attention.
